Cohabitation
Posted in Belgium forum 14 Nov 2011, 10:11
I am applying for cohabitation status with my Belgian girlfriend and wondered if there is anyone who knows whether a "pre-nup" type of agreement is advisable or are there no 'pre-marital' asset issues if there is a split in the futrure. Thanks.

Assets acquired prior to cohabitation remain individual property

I am not a legal expert but assets acquired prior to the date of cohabitation contract remain individual property, unless a prenuptial agreement was made at a notary that states otherwise. All assets acquired, after a cohabitation contract has been signed at the community hall or notary become common. This website explains the most important legal implications. Unfortunately in Dutch. I could not find an English version.

Marriage is not as popular as it once was.

Marriage is not as popular as it once was. According to Pew Research, only 51 percent of American adults marry anymore. The amount has never been that low before. Increasingly, partners are choosing to stay together without the license and the wedding ceremony. These people may want to use cohabitation agreements -- contracts that protect personal belongings in case of a breakup, much like a prenuptial agreement.
