IQAMA TRASNFER UNDER NEW NITAQAT SYSTEM AND PROFESSION CHANGE

AssalmuAlaikum;

Dear brothers,

I am in Jeddah for more than one year and my profession on iqama is “Sabbak” (Plumber). I am still on Azad visa and as I said one year is gone. My kafeel is in Jeddah also and he is Yellow under the new Nitaqat system. I am MBA, PMP, ITIL v3 and working in an IT firm which is in GREEN Category. The employer has not asked me for profession change and transfer yet but will do as I heard from other employees. I have my degrees with me attested from Saudi Cultural Commission and Saudi Embassy in Islamabad as well. My questions are;

1. Can one take transfer from yellow cat company to green cat co. as I heard red to green is easy, green to green is not allowed, what about yellow to green?
2. As it is not yet 2 years complete, Can I take transfer to my current green cat employer?
3. Do I have to change profession first to take transfer to this IT Co.?
4. Can my current green cat employer has the authority to take transfer and change the profession subsequently?
5. My kafeel I asked him to change my profession but he refused and said it is very difficult nowadays and he cannot.

Kindly in the above scenario what is the best way to approach?

    My Sponsor is in RED cat and my current employer is in GREEN. I came to KSA 8 Months ago on AZAD visa my profession is KARABAI MUBANI, can I get Transfer from current sponsor to EMPLOYER immediately or have to wait for 2 yrs.

    Dear brother, thanks for the reply to my question.

    Here is some info I have gathered on the Green Category companies.

    If your company falls under the Green category, you will be able to:

    Apply for new visas once every two months.
    Change the professions of your foreign workers, with the exception of positons restricted to Saudis.
    Get a six-month grace period after the expiry of your zakat and revenue certificates.
    Renew work permits of current foreign employees given that their residency visas are valid for at least three months.
    Recruit employees from companies within the Red or Yellow categories and transfer their visas without permission of their employer

    Please note that these rules will come in effect fully after 23-Feb-2012. This is when the current offer by govt. to change professions easily will expire.

    Sorry for my limited info but I have been here in Saudi Arabia for only 3 months now so I do not have any deep knowledge regarding your particular case. I am working as programmer in a construction company. I was given labor visa and now my company is helping me get my profession changed.

    As far as I can see there are 2 things u can do.
    1. Let your current kafeel know about the current easier process and argue to change his mind to help you change your profession.
    2. Inform your new company of the nitaqat rules and argue to help change your profession after transfer.

    Thanx for your reply brother. But the Co. where i am working is an IT Co. and they said that i will have to change my profession first so that they can get transfer. What is the other way to change the profession now?

    Regarding your question, there is one letter only addressing both the Saud Cult Commission (Mulhagiya Al-Saqafiya) and Saud Embessay (Safara Al Saudia).

    Since your kafeel has refused to change profession on iqama it is logical to get transfer first and then change profession later. Having said that, however the change of profession process has been made very easy till the third week of february 2012 for all company categories, In many cases even the original degree/diploma is not required. I think (but not sure) you only need letter from employer, copies of degree/diploma+iqama+passport. The govt has given the authority to mandoob to change the profession online The fee is 1000 SR. But you should check with someone else also regarding this process.

    I have a question of my own. Regarding the attestation from culture and embassy, do we require separate letters from company for both of one letter is sufficient? Agent has said that it may be a problem as I have only given him letter addressed to embassy. Thanks.
