Going on Yearly Vacation and Never Come Back to Qatar

I need true advice in case I will go on yearly leave and cannot return back to Qatar what will happen?? what action company will take If I will not return ??Is there any way company will take legal action against me??

I am working in IT department in one of the companies in Qatar.My date of joining is in December 14. My contract is open or indefinite but can be renewable after two years .I can avail leave every year but on my own tickets and after 2 year i.e completion of contract on company tickets.

As per the month states,I am working here from past 5 months.my planning is to go on my yearly vacation that is due in Dec 2015. but I am planning to take my leave in Nov 2015 because in December,Christmas and new year holiday fall and the flight tickets will become very expensive.

I have got the leave request approved from my Boss. I also booked my flight tickets online so that I will get a cheap rate for flight tickets.It will commence from mid of Nov to Mid of Dec this year.I don't have any loans or financial liabilities on me in Qatar.

It is our company internal hr policy that whosoever will go on first time vacation will have to provide a guarantor(guarantor is our company colleague or friend who know me) that I will come back after completion of my vacation.In case I will not return back company will take the penalty from the guarantor of the remaining period left which will be 1 year in my case).

I neither want my company nor my guarantor(my friend) to suffer that's why i will give 1 year penalty to my colleague(friend) when I will go on leave.when i will not return back he will submit that amount to the company for the 1 year left.I know it is not a right way.It is a breach of contract but I have this option open in front of me.my department boss is aggressive in nature,will not approve my resignation as we have shortage of IT Employees.

I need advice in case I will go on vacation and cannot return back.what will happen?? will company spear me as I would submit the penalty through my guarantor or what action company will take??Is there any way company will take legal action against me??I don't have any loans or financial liabilities on me in Qatar.

Other queries which I wish you guys to answer.

1) If I will get another job offer in Qatar can i come back and join it after may be in a year or so??

2) Can I apply and get a job & visa in any other gulf countries after taking this step??

3) Also tell me the calculation of 1 year amount I need to give to it to my guarantor??

    I come to know from my old colleagues that If a person goes on vacation and not return after 7 days of the vacation due date company will automatically terminate that person.Now my question is if I will not return company will terminate me but can they provide relieving letter or experience letter If request them??

    Thanks Hello Prince for positive response.Also I am glad that you have replied all of my questions in a good manner.with reference to my last question it is stated in my offer letter that if you resigned with in two years of contract period you will be required to refund the employer all the expenses related to your hiring.In my case they have hired me from a recruitment agency,I have paid recruitment fees also to that agency,which I think my company did not know about.Also company had paid them their recruitment cut.Accommodation,food and transport are providing from my company so no need for them to charge me.Apart from Resident permit what else will come in recruitment cost?? like medical fees, Qatar ID etc.

    Yes you can do that and no worries, it looks a bad company you work for.

    For your other questions:
    1) If I will get another job offer in Qatar can i come back and join it after may be in a year or so?? Yes you can unless they banned you from entering to Qatar which is difficult for them to do cause they have no logical reason.

    2) Can I apply and get a job & visa in any other gulf countries after taking this step?? Absolutely.

    3) Also tell me the calculation of 1 year amount I need to give to it to my guarantor?? It will be up to them to calculate, maybe they only want the cost of the Resident Permit which is QR1210, maybe also they want the cost of house rent or any other costs, so you should ask them or older employees in your company.
