I bought apartment in Berlin in 2015 but it is not registered until now ?

I bought apartment in Berlin in 2015 but it is not registered in Land Register until now ?
My lawyer said that registration will not take place until the remaining 5% is paid.
He said the 5% is held in my account until "refurbishment" is done in the building so we are sure that the seller will pay this not me.
Did anyone experience anything like this ?
