Want to transfer company but already signed the contract

hello all! I was hired by a company and signed the contract last 21 Dec. I have been working for a week now but I was really not happy because of the nature of the job where I was assigned and my salary is not quite fair. But since I was on a visit visa and still have no GCC experience I took the offer apart from the fear that I might have to exit to Kish for a month. ( I heard a lots of sad stories) Now, I have a better offer with another company and the position is what I really seek for. I would really like to transfer though I think it would be quite impossible for me considering the fact that they have already taken my original passport and visa. Can it still be possible? I'm also wondering where will I find the information about the status of my working visa since they told me it has been processed and I will have to pay plus I will be banned if I quit with my current job. Kindly shed some light. Your comments and kind advice will be cherished. Thank you.

    Dear Muhammed,

    First of all it is not right for you to be on a sales designation when in fact you are a chemist in your company. Chemist profession is available at the Ministry of Labor System and therefore you can use the same.

    You cannot take this designation if your company's business activity as per the license is not related to chemicals, but if it does then there is no problem.

    To take this designation you should be have similar educational certificate dully attested in the UAE embassy in your country and over here in the Ministry of Foreign Affairs.

    Considering that you have rendered only six months in your company, you will have an automatic 6 months labor ban. If you wish to work for another company under the Federal Government and Ministry of Labor, you must target higher salary and designation to lift the labor ban.

    You can also look for a job in Free Zones or in the government. These are having separate jurisdiction which are not under the Ministry of Labor, that is why the labor ban does not apply.

    If you are being maltreated and experiencing unfair labor practices from your employer. You may personally come to the MOL office to file a complaint. You need to first go to a typing center (inside MOL compound) and have the application prepared. Be sure to bring your labor card and passport copies. Then you may proceed and file the complaint. The Ministry will then call you and the employer to be present at the MOL for the arbitration of the complaint. MOL will then decide based on the arbitration. If settlement has been made it is good for you. However, MOL is not really a court. The case can still be brought to Dubai court for further trial, in case settlement has not been reached.

    Dubai court will do the trial and decide accordingly.

    My suggestion is for you to settle the matter first with your management. If it does not go, then go to MOL.

    Dear frenz....
    I have been working in a company for past 6 months and i am not satisfied with my designation. As i was supposed to join as a Chemist but my designation is Sales.
    If i resign my job will the company impose ban on me coz i have not completed the contract of two years. Does this ban can be lifted?

    And one more thing wht can be a employee can do if the company officials treat them very rude nd mentally irritate by abusive words every now and then and ruin the peace of mind even though its heigher management ?

    Any Legal consultant plz get me details on this very soon and very clear and promt. I need to move on your suggestions.

    You are currently having an Abu Dhabi visa, and I am assuming you have a labor card issued by the Ministry of Labor. Hence, your visa is under the Federal Government, issued by the Ministry of Labor and you are a resident of Abu Dhabi.

    You were offered a job in a free zone, which is an entirely different jurisdiction. Hence, you should not be having a 6 month automatic Labor Ban since you will not be under Ministry of Labor. Instead you will have a visa under the free zone authority.

    You will be having a labor ban if you will transfer to any company under the Ministry of Labor, be it in Dubai, Abu Dhabi, Sharjah etc.

    The ban can be lifted if your new company will give you higher designation and salary. It is good that you have a masters degree (be sure it is attested) this will help you move to another company.

    You have to pay them since you did not finish your limited contract. This is regardless of whether you have a new job in any other company.

    Hi Astatin,

    Well, there is a 2 yrs minimum period that you have to complete b4 to leave a company. but i am also a bit unsure if its a Freezone company you are moving into than i guess you won't have to complete 2 years.

    The best place to get this info is:
    UAE visa information sources dnrd.gov.ae or dnrd.ae - Department of Naturalisation and Residency Dubai (DNRD) website - should be the most up to date source.

    If u just log on to DNRD site and go to E-Services , there you will find a tab E-Chat . once u enter in the chat room , soon a representative from DNRD will address your problem and give you the solution.

    If you get the info please do update me as well about the solution.

    well,
    u can transfer to any company at any point of time, there wont any bans any more and as far as govt company is concerened
    firstly they wont hire u if there is any issue
    secondly if they have already hired u then no 1 in entire UAE can bann u. confirmed
